Preparing your property to let
Before your property is marketed, it is important to make sure it is safe, well presented and ready for occupation.
You may need to:
- Obtain permission from your mortgage lender
- Check the terms of any lease or freeholder agreement
- Arrange appropriate landlord insurance
- Obtain a valid Energy Performance Certificate
- Complete the required gas and electrical safety checks

Tenancy agreements
Since 1 May 2026, most private tenancies in England operate as assured periodic tenancies rather than fixed-term assured shorthold tenancies.
An assured periodic tenancy continues on a rolling basis until it is ended correctly by the tenant, by mutual agreement or by the landlord using an applicable legal ground for possession.
Hawksgrove Estates will help ensure that the appropriate tenancy documentation and prescribed information are prepared for your property. Specialist legal advice should be obtained where a company tenancy, common-law arrangement or another non-standard agreement is required.
Deposits
Where a tenancy deposit is taken, it must normally be protected in a government-approved tenancy deposit scheme within the required timeframe. The tenant must also receive the relevant prescribed information.
The maximum deposit is generally:
- Five weeks’ rent where the annual rent is below £50,000
- Six weeks’ rent where the annual rent is £50,000 or more
A detailed, independently prepared inventory and schedule of condition is strongly recommended. It provides important evidence of the property’s condition at the beginning and end of the tenancy and can be invaluable if a deposit dispute arises.
Landlord safety responsibilities
Landlords are responsible for providing a property that is safe and free from serious hazards.
Depending on the property, the requirements may include:
- An annual gas-safety inspection by a Gas Safe registered engineer
- A valid electrical installation condition report
- Safe electrical appliances supplied with the property
- Smoke and carbon monoxide alarms installed and tested as required
- Fire-safe furniture and furnishings
- A valid Energy Performance Certificate
- Safe access and escape routes
- Legionella risk assessment
- Compliance with any HMO or selective licensing requirements
- Keeping the structure, exterior, heating, water and sanitation installations in repair
Safety requirements can change, so landlords should seek current professional advice rather than relying on old tenancy documents or guidance.
Repairs and maintenance
A well-maintained property is more attractive to tenants, supports longer tenancies and helps protect its value.
Landlords remain responsible for many repairs, including the structure and exterior of the property and its key heating, water, electrical and sanitation installations.

Overseas landlords
If you normally live outside the UK, the Non-Resident Landlord Scheme may apply to your rental income.
Unless HMRC has authorised gross payment, a letting agent—or in some cases the tenant—may be required to deduct basic-rate tax before passing rent to an overseas landlord.
